1010 Coding Privacy Policy

Welcome to 1010 Coding Service. 1010 Coding is an online academy that allows students between ages 7-18 learn about a wide variety of topics, including coding, graphics, data management, and other subjects, anywhere. Users work with instructors via video conference to learn a range of topics, including Python, Excel, CSS Scripts, and other programming languages.

This Privacy Policy describes how 1010 Coding, Ltd. (“1010 Coding”, “we”, “us”, and/or “our”) handles the personal information we collect from and about you when you visit our website, www.1010Coding.com (“the Site”, “the Service”), or when you otherwise interact with us. It also describes certain legal rights you may have, subject to applicable law, and how you can exercise them.

For the purposes of this Privacy Policy, “Personal Information” means information about identified or identifiable individuals, such as their name and email address, and includes “personal data” as defined by the Economic Community of West African States (ECOWAS) Supplementary Act on Personal Data Protection.

By using 1010 Coding’s Service, you confirm you have agreed to the 1010 Coding Terms of Use, to the extent permitted by law, and have read and understood this Privacy Policy.

A Note for Minors: In order to register for 1010 Coding classes you must be over the age of 18. Parents registering for 1010 Coding on behalf of their child, must give their consent at the time of registration to permit us to collect Personal Information from their child.

A . INFORMATION WE COLLECT

I. Information you give us directly.

We collect information that you voluntarily provide in the following ways:

  1. Information collected when you request information or join 1010 Coding. When you fill in forms on our Site including when you request additional information about our Service, request a trial, or contact our Admissions Advisors, we may require that you provide us with certain information such as your first and last name, email address, phone number, and time zone, as well as your child’s name, age, your weekly availability, how you heard about 1010 Coding, and any other information about your child that you believe is relevant for us to know. If you choose to purchase classes, we require that you provide us, or our third-party payment processor, Paystack, with your name, payment card information, and billing address.
  2. Information collected when creating your child’s account. If you enroll for our Service, we will provide you with an invitation link that will give you access to the 1010 Coding Learner Portal. We will populate your family’s account with the information supplied during registration and ask you to set a password for that account that can be shared with your family. We will also request your child’s Month, day, and year of birth. Later your child may choose to add information such as a username, profile photo, biographical information, location, projects s/he is working on, and videos about these projects. We advise students to choose a username that does not reveal their real name or any other information that could identify them. Other 1010 Coding users will be able to see your child’s username, chosen avatar or profile photo, general location, and any other content they choose to make public.
  3. Information collected from instructors. When instructors join 1010 Coding, we ask them to provide us with their email addresses and create a password for their accounts. Like students, instructors can choose to add information such as a username, profile photo, biographical information, and their location. Over time, we may collect information about the classes instructors are associated with, their responses to surveys and feedback requests, and reviews from their students.
  4. Information collected when you or your child contacts us. When you or your child contacts us by email; through our branded social media accounts; through any integrated chat providers we may provide, or by telephone, SMS, or physical mail, we may collect your (or your child’s) name, username, email address, phone number, physical address, and the contents of your communication which can include any information you (or your child) choose to provide. We will only use that information for the purpose of providing the service or support requested.
  5. Information collected when registering for a competition, signing up to receive newsletters from us, subscribing to our blog, or completing a survey. When you engage in any of these activities, we may collect your name, email address, and phone number as well as your child’s name, age, grade level, past programming experience, and any information you provide to us as part of that request (such as information about your user experience in response to a survey).
  6. Information collected through user-generated content. We collect any information that your child provides to us when he or she creates projects, writes comments, or posts on forums accessible to other 1010 Coding students and instructors. This information includes the student’s username, the contents of his or her code, the output of the code, the name s/he gives to the project, and any other information s/he chooses to include.
  7. Inviting others to use 1010 Coding. Our Service allows you to invite others to use 1010 Coding. If you do this or are invited in this way, we will collect and store the invitee’s email address to enable us to send an invitation. We will also let the invitee know who invited them to use 1010 Coding and let him/her request that his/her information be deleted from our systems.
  8. Information collected when you scan your badge or otherwise leaving your details with us at a trade show or other marketing event. In these circumstances, we may collect details such as your name, company name, job title, address, phone number, and email address.
  9. Information collected when you apply to work with us. If you apply to work with us, we will collect any information you choose to share in your application, including your name, email address, phone number, physical address, employment history, and education history.

II. Information we collect automatically when you use our Service.

We also collect certain information automatically as you navigate our Service.

  1. Log Data. Like many websites, 1010 Coding’s website collects certain information automatically and stores it in log files. This may include information about the devices you use to access our Service (including your internet protocol (IP) address, browser type, and operating system); the address of the web page visited before and after using our Service; details about your interactions with our Service (such as the date, time, length of stay, and specific pages accessed during your visits); search terms used to reach our Service; and usage information (such as the number and frequency of visitors to our Service). We use this information to help us design and administer our website, improve our Service, and gather broad demographic information that helps us identify visitor preferences.
  2. Student Activity Data. We also collect certain information about students’ activities on the 1010 Coding Learner Portal. For instance, we collect information about when a student is working on a project or whether a student has completed a particular video in order to help our instructors monitor how a student is progressing throughout the week and to help 1010 Coding improve its Service.
  3. We collect some of the information above using cookies and similar technologies. A “cookie” is a text file that websites send to a visitor’s computer or other internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. 1010 Coding uses cookies and user session data to remember whether you are logged in, ensure that the Site functions properly, determine how many users have visited certain pages, and prevent fraud. You can disable cookies, limit the types of cookies you allow, or set your browser to alert you when cookies are being sent. Please refer to the guidance offered by your chosen web browser if you’d like help managing your cookie preferences.

We do not use cookies or similar technologies to track your activities on non-1010 Sites & Services or to serve you advertisements based on your browsing activities on non-1010 Sites & Services.

If you choose to decline cookies, you may not be able to fully experience the functions of 1010 Coding Sites & Services and/or some of our services will function improperly, in particular the inability to log in or manage items in your shopping cart. We do not share cookie data with any third parties.

We also use third-party analytics tools to execute and track display advertising, including remarketing advertising on other websites. These tools help 1010 Coding understand which ads bring users to our site and inform and optimize the ads served.

III. Information we collect from other sources.

  1. Payment Processors. In general, when you purchase classes from 1010 Coding, your payment card information is provided directly to our third-party payment processor, Paystack, and 1010 Coding does not collect or store that information. However, we may receive limited information about your payment card from Paystack, such as the last four digits of your card, the country of issuance, and the expiration date.
  2. Publicly Available Sources and Other Third Parties. We may obtain Personal Information about you from other sources, including public records, publicly available information on internet sites, and third parties that help us update, expand, and analyze our records and inform our marketing and recruitment efforts. For instance, we may use information from LinkedIn or from a third-party data provider to update information about you in our contact database.
  3. Another 1010 Coding User. We may collect your Personal Information from another 1010 Coding user if that user provides us with your email address to invite you to try 1010 Coding.
  4. 1010 Coding Instructors. We also collect information relating to your child from our instructors. For instance, instructors provide session notes about the classes they are leading and may provide specific notes about individual students’ learning styles and habits. They may also provide feedback on students’ performance directly to students and their parents.
  5. Social Media. You also can engage with our content, and other offerings, on or through social media services or other third-party platforms, such as Facebook, or other third-party social media plug-ins, integrations, and applications. When you engage with our content on or through social media services or other third-party platforms, plug-ins, integrations or applications, you may allow us to have access to certain information in your profile. This may include your name, email address, photo, gender, birthday, location, an ID associated with the applicable third-party platform or social media account user files, like photos and videos, your list of friends or connections, people you follow and/or who follow you, or your posts or “likes.” For a description on how social media services and other third-party platforms, plug-ins, integrations, or applications handle your information, please refer to their respective privacy policies and terms of use, which may permit you to modify your privacy settings.

When we interact with you through our content on third-party websites, applications, integrations, or platforms, we may obtain any information regarding your interaction with that content, such as content you have viewed, and information about advertisements within the content you have been shown or may have clicked on.

We may combine the information we collect about you from these various sources. If a combination of information that we collect identifies you as an individual, we will treat the combined information as Personal Information.

B. HOW WE USE YOUR INFORMATION

We use the information described above to:

  • Provide you with the Service if you are or become a 1010 Coding customer, including creating your 1010 Coding account and identifying you when you sign in to your account.
  • Deliver a high-quality and customized learning experience.
  • Verify your student’s age.
  • Process your purchases through our Service.
  • Operate and improve our Service, including monitoring and analyzing usage, trends, and activities related to the Service.
  • Send you technical notices, updates, security alerts, and support and administrative messages and information about the rules of the Site and Service.
  • Identify, fix, and troubleshoot bugs and service errors.
  • Respond to your requests, inquiries, comments, and suggestions.
  • Communicate with you about products, services, offers, promotions, and events we offer and provide news and information we think will be of interest to you.
  • Post testimonials from parents.
  • Publish the names of winners or high performers.
  • Send your child prizes for performance in competitions.
  • Improve our educational, networking, marketing, social, and recruitment strategies.
  • Assess job applicants and make hiring decisions.
  • Protect against, identify, investigate, and respond to misuse of our Service or other unlawful behavior.
  • Facilitate the sale or potential sale of our business or any of our assets.
  • As required by law.
  • Carry out any other purpose described to you at the time the information was collected.

We do not use Personal Information to engage in targeted advertising to children and we do not create or build personal profiles of students other than for educational purposes or as specifically authorized by a parent or legal guardian.

C. HOW WE SHARE YOUR INFORMATION

We may share information about you with certain third parties in the following circumstances:

  1. Companies under common control: We may share data between and among any current or future parents, subsidiaries, affiliates, and other companies under common control and ownership with 1010 Coding.
  2. Vendors and service providers: We may share Personal Information with vendors, consultants, and other service providers who need to access the data in order to perform services on our behalf, such as providing cloud-hosting or cloud-storage services.
  3. Business transfers: We may share Personal Information with another company in connection with or during negotiations of any merger, acquisition, financing, reorganization, bankruptcy, sale of all or a portion of our assets, or transition of services to another provider.
  4. Legal requirements: We may access, preserve, and/or disclose the information we collect and/or content you and/or your student/child provides to us (including information posted on our forums) to a law enforcement agency or other third parties if required to do so by law or with a good faith belief that such access, preservation, or disclosure is reasonably necessary to: (i) comply with legal process; (ii) enforce the Terms and Conditions of 1010 Coding Sites & Services; (iii) respond to claims that the content violates the rights of third parties; or (iv) protect the rights, property, or personal safety of the owners or users of 1010 Coding Sites & Services, a third party, or the general public. We also may disclose information whenever we believe disclosure is necessary to limit our legal liability; to protect or defend our rights or property; or protect the safety, rights, or property of others.
  5. Consent: We may share Personal Information with third parties with your consent and at your direction, including if we notify you that the information you provide will be shared in a particular manner and you provide that information.
  6. 1010 Coding Instructors: In the course of providing our Service, we also share Personal Information about students with our instructors to enable instructors to communicate with students and to assist instructors in understanding each student’s individual needs and capabilities.
  7. Social Media Platforms: Our Service may offer social sharing features and other integrated tools such as widgets, which allow students to share information from their 1010 Coding account with third-party social media platforms like Facebook or Twitter. Using these social sharing features is optional.
  8. Public Forums and Publicly Available Content: We offer several features that allow our students to connect and share content in public or semi-public spaces. Students do not have to use these features, but if they do, they should be sure to use good judgement. Certain information in students’ profiles such as their username and photo or avatar, the projects they choose to share, and any other information they disclose in the public or semi-public areas of 1010 Coding’s Service, may be read, collected, stored, or used by others.

We may also share aggregate or de-identified information, which cannot reasonably be used to identify you, for various purposes including compliance with various reporting obligations; for business or marketing purposes; or to assist third parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Service.

D. OUR LEGAL BASES FOR HANDLING YOUR PERSONAL INFORMATION

The laws in some jurisdictions require companies to tell you about the legal grounds they rely on to use or disclose your Personal Information. To the extent those laws apply, our legal grounds are as follows:

  1. Legitimate interest. In most cases, we handle Personal Information on the ground that it furthers our legitimate interests in commercial activities such as the following in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals:
  • Providing the Service pursuant to our contract with our customers
  • Marketing our business
  • Protecting our customers, personnel, and property
  • Analyzing and improving our business
  • Processing job or other applications
  1. Legal compliance. We need to use and disclose Personal Information in certain ways to comply with our legal obligations.
  2. To honor our contractual commitments to an individual. Some of our processing of Personal Information is to meet our contractual obligations to the individual to whom the Personal Information pertains.
  3. Consent. Where required by law, and in some other cases, we handle Personal Information based on implied or express consent. For instance, in relation to direct marketing, we will obtain and rely on your consent in relation to the processing concerned.

E. YOUR RIGHTS AND CHOICES

You have a variety of rights and choices related to our use of your Personal Information.

  1. Opting out of email marketing. You can opt-out of receiving our promotional emails at any time by following the instructions included in those emails. Please be aware that it may take up to 10 days for us to process your request, and you may continue receiving promotional communications from us during that period. If you opt-out of receiving such communications, please note that we may continue to send you non-promotional emails (such as emails related to our business relationship or emails about changes to our legal terms).
  2. Restricting cookies/Do Not Track. 1010 Coding does not change its behavior in response to web browser “do not track” signals. However, you can configure most browsers to reject cookies or to notify you when you are sent a cookie, giving you a chance to decide whether or not to accept it. You can consult the help section of your browser to find out how to do this. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Service.
  3. Limiting Information in Your 1010 Coding Profile. You can control the information we collect about you or your child by limiting what information you provide in your 1010 Coding profile.
  4. Limiting Information Available Through Social Media Platforms. If you want to limit or stop receipt of information from third-party social media platforms, you can change your privacy settings on those other websites. You also may choose not to use social features we make available.
  5. Access, Update, or Delete Your Information. If you are already a 1010 Coding user, you may access, update, or delete Personal Information you have provided through your account settings or by emailing us at legal@1010coding.com. You may also remove certain optional information that you no longer wish to be publicly available through the Service, such as your photo or avatar. If you no longer wish to use the Service, you may close your account. To learn how to close your account, please email legal@1010coding.com. Please note that we may keep certain Personal Information as necessary to comply with our legal obligations or for legitimate business purposes, such as to resolve disputes or enforce our agreements. We may also keep cached archived copies of Personal Information for a certain period of time.
  6. Data Requests. In some instances, you may be eligible to request that we provide access to and/or a copy of certain Personal Information we hold about you; ask that your Personal Information be corrected, updated, or erased; object to our processing of your Personal Information; request that we restrict certain processing; transfer your Personal Information to a third party; or honor your withdrawal of consent for certain processing of your Personal Information.

We will consider all requests and provide our response within the time period stated by applicable law. Please note, however, that certain information may be exempt from such requests in some circumstances, which may include if we need to keep processing your information for our legitimate interest or to comply with a legal obligation. Before responding to your request, we may require that you provide us with additional information to confirm your identity. You have the right to lodge a complaint with the authorities applicable to your situation. However, we invite you to contact us with any concern, as we would be happy to try to resolve it directly.

F. CHILDREN’S PRIVACY

Many features of our Service are intended for adults, including parents or legal guardians and instructors. We do not knowingly collect Personal Information from children in connection with these features. If you are a parent or legal guardian and think your child under the age of 13 (or a higher age threshold where applicable) has given us Personal Information without your consent, please contact us at legal@1010coding.com.

When we do intend to collect Personal Information from children, we take additional steps to protect children’s privacy, including:

  1. Notifying parents about our information practices with regard to children, including the types of Personal Information we may collect from children, the uses to which we may put that information, and whether and with whom we may share that information;
  2. In accordance with applicable law and our practices, obtaining consent from parents for the collection of Personal Information from their children, or for sending information about our products and services directly to their children;
  3. Limiting our collection of Personal Information from children to no more than is reasonably necessary to participate in an online activity; and
  4. Parental/Guardian Rights. Giving parents access or the ability to request access to Personal Information we have collected from their children and the ability to request that the Personal Information be changed or deleted.
  5. Restriction on Child users. Children under 13 years of age are prevented from accessing areas of the Service which include, but are not restricted to, client account information unless approved by their parent or guardian and any course content defined as age-inappropriate by the Entertainment Software Rating Board (ESRB).

We adhere to earlier stated verifiable consent, except where:

  • the sole purpose of collecting the name or online contact information of a parent or child is to provide notice and obtain parental consent;
  • the purpose of collecting a parent’s online contact information is to provide voluntary notice to, and subsequently update the parent about, the child’s participation in our Services that do not otherwise collect, use, or disclose children’s personal information;
  • the sole purpose of collecting online contact information from a child is to respond directly on a one-time basis to a specific request from the child, and where such information is not used to re-contact the child or for any other purpose, is not disclosed, and is deleted by us promptly after responding to the child’s request;
  • the purpose of collecting a child’s and a parent’s online contact information is to respond directly more than once to the child’s specific request, and where such information is not used for any other purpose, disclosed, or combined with any other information collected from the child;
  • the purpose of collecting a child’s and a parent’s name and online contact information is to protect the safety of a child, and where such information is not used or disclosed for any purpose unrelated to the child’s safety;
  • we collect a persistent identifier and no other personal information and such identifier is used for the sole purpose of providing support for the internal operations of our Services; or
  • otherwise permitted or required by law.

G. FORUMS AND CHATS

We may offer forums and chat rooms. Please be aware that anyone may read postings on a forum or in a chat room. Furthermore, any information which is posted to a forum or chat room could include personal information, which would be disclosed and available to all users of that forum or chat room and is therefore no longer private. We cannot guarantee the security of information that any user discloses or communicates online in public areas such as forums and chat rooms. Those who do so, do so at their own risk. We reserve the right to monitor the content of the forums and chat rooms. If age-inappropriate content or potentially identifiable information is seen, it may be removed or edited by us for security, privacy, and/or legal reasons. We will not republish postings from forums or chat rooms anywhere on the Web.

H. LINKS TO OTHER WEBSITES AND THIRD-PARTY CONTENT

We may provide links to third-party websites, services, and applications that are not operated or controlled by 1010 Coding. This Privacy Policy does not apply to the privacy practices of those third parties. The fact that we link to a website, service, or application is not an endorsement, authorization, or representation of our affiliation with that third party. We encourage you to review the privacy policies of any third-party service before providing any Personal Information to or through them.

I. DATA TRANSFER

Personal Information we collect may be stored and processed for the purposes set out in this Privacy Policy in Nigeria where we are based or in any country where we have operations or where we engage vendors or service providers. These countries may not have the same data protection laws as the country in which you originally provided the data. By using our Service or submitting your Personal Information to us, you agree to such transfers.

Where Personal Information is transferred outside ECOWAS Area to a third party in a country that is not subject to an adequacy decision by ECOWAS, we take appropriate steps to provide the same level of protection for the processing carried out in any such countries as you would have within ECOWAS Act to the extent feasible under applicable law. J. DATA RETENTION

We only keep your Personal Information for so long as reasonably necessary for the purposes described in this Privacy Policy, as required by law, or as necessary to resolve disputes and enforce our rights and agreements. To dispose of Personal Information, we may anonymize it, delete it, or take other appropriate steps. Data may persist in copies made for backup and business continuity purposes for additional time.

K. SECURITY

1010 Coding uses generally accepted administrative, physical, and technical safeguards we believe are appropriate to protect the confidentiality, integrity, and availability of your Personal Information. Although we make reasonable efforts to protect Personal Information from loss, misuse, or alteration by third parties, you should be aware that there is always some risk involved in transmitting information over the Internet and storing information electronically. 1010 Coding cannot and does not guarantee absolute security.

L. TERMS AND CONDITIONS

Your use of our Services, and any information you provide on our 1010 Coding Sites & Services, are subject to the terms of 1010 Coding, Ltd. Terms and Conditions which can be found at  1010coding.com/terms-and-conditions.

M. CHANGES TO OUR PRIVACY POLICY

We may change this Privacy Policy from time to time to reflect changes in our practices or in the law. If we make changes to this policy, we will post the updated Privacy Policy on our website with the “Effective as of” date reflecting the date of the latest version. You are advised to review this policy periodically to stay informed of our practices. If we make material changes, we may provide you with additional notice, such as posting a statement on our homepage or sending you an email notification, if we have your email address on file. Your continued use of the Service after the revised Privacy Policy has become effective indicates that you have read, understood, and agreed to the current version of this Privacy Policy, to the extent permitted by law.

N. SOCIAL NETWORKING DISCLAIMER

1010 Coding provides several opportunities for social networking for both participants and staff on sites such as Facebook, Instagram, Twitter, Flickr, and YouTube. These sites are not affiliated with 1010 Coding and offer their own individual social networking services. Please read the following Terms and Conditions carefully, as well as the Terms and Conditions of the sites in which 1010 Coding has created a forum (“Group”). These Terms and Conditions are a legal agreement between you and 1010 Coding and apply to you whether you are a visitor to these sites or any site with an official 1010 Coding affiliation.

You understand that by registering for a 1010 Coding program, your participant(s) may access and upload content to social networking sites. In order to access certain features of the social networking sites or pages on 1010Coding.com, and to post Member Submissions, the majority of these sites require that the user open an account with them. Please note that these sites have their own individual Terms and Conditions that must be followed. Age requirements are outlined within each Site’s Terms and Conditions. You hereby authorize your participant to access social networking sites while at camp and create an account if they choose to do so and if they meet the requirements listed by each site to create an account.

Interaction with other users:

  • 1010 Coding is merely providing a medium in which to socialize online with fellow participants. Users are solely responsible for interactions (including any disputes) with other Members and any volunteers that may advise and assist participants with projects and activities via your use of the Services.
  • You understand that 1010 Coding does not in any way screen Members or review or police: (i) statements made by Members in their Member Submissions or the Member Submissions in general; or (ii) statements made by Users or any information a User may provide via the Services.
  • You understand that your participant(s) is solely responsible for, and will exercise caution, discretion, common sense, and judgment in using the various Services and disclosing personal information to other Members or Users.
  • On behalf of your participant(s), you agree that they will take reasonable precautions in all interactions with other Members, particularly if they decide to meet a Member offline or in person.
  • Your participant’s use of the social networking sites with which 1010 Coding is affiliated, their services, and/or Content and Member Submissions, is at your sole risk and discretion and 1010 Coding hereby disclaims any and all liability to you or any third party relating thereto.
  • On behalf of your participant(s), you agree that they will not harass, threaten, intimidate, bully, stalk, or invade the privacy of any individual in connection with your use of the social networking sites with which 1010 Coding is affiliated and their services, whether or not an individual is a 1010 Coding Member; and you further agree not to advocate such activities or to encourage others to engage in any such activities.
  • You and your participant(s) should also be aware that under no circumstances are 1010 Coding employees allowed to give personal contact information for social networking sites.

O. COPYRIGHT & INTELLECTUAL PROPERTY POLICY

You agree that you and your participant will not use the social networking sites to offer, display, distribute, transmit, route, provide connections to, or store any material that infringes copyrighted works, trademarks, or service marks or otherwise violates or promotes the violation of the intellectual property rights of any third party. 1010 Coding, Ltd. has adopted and implemented a policy that provides for the termination in appropriate circumstances of the accounts of users who repeatedly infringe or are believed to be or are charged with repeatedly infringing the intellectual property or proprietary rights of others.

P. DISCLAIMER

BY USING THE SOCIAL NETWORKING SITES OR SUBMITTING A MEMBER SUBMISSION, YOU AGREE THAT 1010 CODING, LTD. IS NOT RESPONSIBLE, AND WILL IN NO EVENT BE HELD LIABLE, FOR ANY: (A) LOST, ILLEGIBLE, MISDIRECTED, DAMAGED, OR INCOMPLETE MEMBER SUBMISSIONS; (B) COMPUTER OR NETWORK MALFUNCTION OR ERROR; (C) COMMUNICATION DISRUPTION OR OTHER DISRUPTIONS RELATED TO INTERNET TRAFFIC, A VIRUS, BUG, OR WORM OR NON-AUTHORIZED INTERVENTION; OR (D) DAMAGE CAUSED BY A COMPUTER VIRUS OR OTHERWISE FROM YOUR ACCESS TO THE SITE OR SERVICES.
